The Fair Housing Act
The Federal Fair Housing Act (Title VIII of the Civil Rights Act of 1968, as amended) prohibits discrimination in the sale, rental, and financing of housing based on the following protected classes:
- Race
- Color
- Religion
- Sex (including sexual orientation and gender identity)
- National origin
- Familial status (families with children under 18, pregnant persons, or persons securing custody of children)
- Disability (physical or mental)
In addition to federal protections, the State of Arizona and local municipalities may provide additional protections under their own fair housing laws.

What the Law Prohibits
Under the Fair Housing Act, it is illegal for any person or entity involved in a real estate transaction to:
- Refuse to sell, rent, or negotiate housing because of a protected characteristic
- Set different terms, conditions, or privileges for the sale or rental of a dwelling
- Indicate a preference, limitation, or discrimination in any housing advertisement
- Deny access to, or membership in, any multiple listing service or real estate organization
- Threaten, coerce, intimidate, or interfere with anyone exercising their fair housing rights
- Steer prospective buyers or renters toward or away from certain neighborhoods based on protected characteristics
- Deny or impose different conditions on a mortgage, home loan, or other financial assistance for housing
